Fenn C. Horton III has been a shareholder since 1994 of the San Jose law firm of Pahl & McCay, PLC, where his main areas of practice are employment law, and business and real estate litigation. He has been a member of the California State Bar since 1985, and the Colorado State Bar since 1986. Mr. Horton received his B.A. (1982) and J.D. (1985) (with distinction) from the University of Iowa, where he served as a published staff member of the Journal of Corporation Law. Mr. Horton regularly advises employers in a variety of industries on legal issues related to employment discrimination, wrongful discharge, wage and hour law, and employment law in general, breach of warranty and limiting warranty liability, contracting with suppliers and customers, protection of intellectual property, misappropriation of trade secrets by employees and competitors, unfair competition, the right to privacy, management’s response to union organizing campaigns, collective bargaining, investigation of workplace misconduct (including, theft, vandalism, drug abuse, and accusations of sexual harassment), prevention of workplace violence, insurance coverage, mergers and acquisitions, and leasing of manufacturing facilities. Mr. Horton is also a frequent lecturer on a wide range of subjects concerning employment law, business litigation, the right to privacy, and commercial law. Mr. Horton is a member of the Judiciary and the Civil Practice Committees of the Santa Clara County Bar Association, and he serves as Judge Pro Tem for the Santa Clara County Superior Court. Mr. Horton is also a research professor with the Naval Postgraduate School in Monterey, and a board member of the Society for the Plastics Industry, Western Region, and the San Jose YMCA (Central). Although Mr. Horton’s practice is located primarily in California, he has also advised employers operating in a number of other states, including, Arizona, Colorado, Illinois, Massachusetts, New York, Minnesota, Nevada, Oregon, South Carolina, Texas, Virginia, and Washington.
