In Texas' latest legislative session, lawmakers tried (but ultimately failed again) to pass a law prohibiting the controversial "swoop and settle" practice used by unscrupulous auto insurance companies. Texas' failure to act on this issue is concerning, as it’s a serious consumer protection issue.

Swoop and settle refers to an insurance tactic used to pressure accident victims into quickly agreeing to inadequate settlement offers over the phone.

While there’s not much (if any) data showing that having a dash cam in your vehicle makes you a better driver per se, the true purpose of a dash cam is to act as a silent and reliable witness should you ever need one.

Not only do dash cams provide irrefutable evidence in the event of an accident, but they can protect you from fraud and potentially even save you money.

If you follow the news or even social media, you’ve probably seen your fair share of ridiculous lawsuit headlines. The stories rarely even originate from your state, but because they drive engagement (i.e., clicks, comments, shares), they often get picked up by countless local news outlets across the country and end up spreading like wildfire.

In many cases, a so-called frivolous lawsuit actually does have merit. It might look ridiculous to you after reading a two-paragraph article, but remember that these stories are often intentionally framed in a particular light in order to grab attention and invoke a reaction.

Most states use what’s called a "modified comparative fault" rule when it comes to determining liability in a car accident. This means that as long as you can show that you were less than 50% at-fault for the accident, you should still be able to recover compensation for your injuries, losses, and other damages.

Most states (including Texas) use what’s called a “modified comparative fault” rule when it comes to determining liability in a car accident.

The parents of Austin McEwen, one of the six victims killed after a tornado pummeled an Amazon warehouse in Edwardsville, Illinois, last month, said Monday during a press conference that they are suing Amazon over the alleged wrongful death of their son.

The family of an Amazon.com delivery truck driver in Illinois who died in December when a warehouse was destroyed by a swarm of tornadoes that killed six people there, filed a lawsuit against the online retailer on Monday over his death.

Premises liability law in Texas states (among other things) that certain events, concerts, businesses, and venues have a “duty of care” to provide reasonable safety and security measures in order to mitigate the risk of foreseeable harm to patrons. Failing to do so open could open them up to liability when and if someone is assaulted, injured, or killed as a result of their negligence.

When it comes to many types of injury cases, liability's fairly cut & dry. The same can't always be said for complex premises liability cases.

While it may seem like a minor issue on the surface, any accident involving more than two vehicles can result in a complex web of overlapping insurance policies, severely-delayed claims, and a smaller pool of money available to compensate the victims for their losses.

Liability is often complex with multi-vehicle wrecks. Unless you act quickly, you could be left in the cold when it comes to compensation.

Claims adjusters spend most of their day investigating insurance claims by collecting statements, consulting police and hospital records, inspecting property damage, and looking at how similar claims have played out in the past. The only thing is, they’re only looking at it from one side. Their ONLY goal is to save the insurance company money by paying out as little as possible on every single claim.

In a perfect world, insurance companies would simply pay victims what they're owed following a serious car accident. Unfortunately, insurance adjusters often unfairly deny claims, blatantly lie to claimants, and will use every trick in the book to skirt liability.

Drunk driving accidents are a serious concern across the country, and especially in Texas. Not only have we spent millions of dollars on awareness campaigns and toughened criminal penalties, but courts in Texas have also started holding irresponsible bars, restaurants, and similar establishments civilly liable for failing to responsibly serve alcohol.

The Texas Dram Shop Act was passed to hold alcohol-serving businesses civilly liable for drunk driving accidents when patrons were illegally over-served.

From the "hot coffee" lawsuit to the woman who sued her nephew over an aggressive hug, the headlines are designed to make us groan—but what’s really driving this type of news coverage?

The bill’s language would essentially shift liability from the company to drivers who may not have the financial means to fully compensate plaintiffs. It may also prevent certain information about a company’s past accident history from being introduced as evidence. So if jurors wanted to know whether a company required drivers to undergo safety training; do routine maintenance on its trucks; or if the company’s drivers have a habit of getting into wrecks, it could be inadmissable.

HB 19’s sponsors say the bill will prevent excessive lawsuits against companies, but road safety advocates say the bill would make Texas roads more dangerous and prevent victims of crashes from receiving justice.

A federal appeals court on Tuesday ruled that Snapchat can be sued in a case in which a young man used the app's "speed filter" feature before a fatal crash.

A federal appeals court on Tuesday issued a stunning ruling: It said a decades-old legal shield preventing platforms from lawsuits should not apply to Snapchat in a case involving a fatal car crash.

According to the Texas Department of Transportation, more than 600 people die in #Texas every year in large truck crashes. HB 19, which is being sponsored by State Rep. Jeff Leach of Plano, would be disastrous for those victims' families.

A Texas House bill is drawing criticism from families of loved ones injured in trucking accidents, but supporters say it would cut down on frivolous lawsuits.

While we would hope that all motorists would be truthful and straightforward about the facts leading up to a serious collision, the truth is that many drivers will flat-out lie in order to shield themselves from liability. This is particularly true if they may have broken the law or depend on a clean driving record for employment.

It’s no surprise that drivers lie in order to avoid responsibility for a crash, but it’s shocking how often investigators rely on a trucker’s testimony.
