Ms. Brauner specializes in employment law, representing employers in a broad range of employment law matters. Ms. Brauner brings more than fifteen years' experience focused almost exclusively on employment law as a litigator and legal advisor. The breadth and focus of her work experience in employment law -- at both large employment law firm practices and venerable boutique employment law firms in New York City -- enables her to provide realistic risk assessments and creative approaches to problem-solving for her clients.
Ms. Brauner counsels employers in many aspects of the employment relationship, including avoidance of litigation, reductions-in-force, lawful hiring and terminations, disability and religious accommodation issues, and compliance with federal, state and local statutes. Ms. Brauner also advises clients on notice and recordkeeping requirements, including necessary documentation relating to the hire of New York employees.
She conducts training of managers and employees on compliance with federal, state and local laws affecting the workplace including laws prohibiting employment discrimination, harassment and retaliation. Training topics may include, but are not limited to: preventing workplace discrimination, harassment and retaliation; managing effectively; conducting internal investigations of discrimination and harassment; preventing workplace violence; reasonable accommodation of disabilities and religious beliefs; compliance with wage and hour laws; compliance with New York's laws affecting the workplace; compliance with other employment laws; and handling social media in the workplace.
She advises clients on proper classification of employees (employee vs. independent contractor; exempt vs. nonexempt from overtime pay laws). She also assists employers in developing and implementing systems and procedures to ensure compliance with employment laws, and conducts internal investigations of complaints of discrimination and harassment.
Ms. Brauner has extensive experience preparing employment agreements, severance agreements, employee handbooks and policies, and related documents. She is a frequent presenter on workplace law-related matters and is a prolific author of employment law-related articles.
Ms. Brauner is a member of the American Bar Association's Labor and Employment Law Section, the New York State Bar Association's Labor and Employment Law Section, the New York City Bar Association, and the Tufts Lawyers Association. She is the founder of Brooklyn Law School's Alumni Mentor Program and Tufts University's New York Women's Networking Group.
