Criminal defense attorney representing clients facing State & Federal criminal charges.
Statutory rape is a crime in which an individual has sexual intercourse with another person who is under the age of consent, as defined by state law. Even if the minor consents, it is still considered statutory rape, as minors are not legally capable of giving informed consent. Statutory rape laws vary from state to state, and in some states, the crime is called "criminal sexual conduct," "unlawful sexual conduct, or "lewd or lascivious battery" Some states have different degrees of statutory rape, depending on the age of the victim and the age difference between the victim and the perpetrator. For example, some states may have different charges for statutory rape if the victim is under a certain age (e.g. 12, 14, or 16) and have harsher penalties. Statutory rape is considered a "strict liability" crime, meaning that even if the perpetrator did not know the victim's age, they can still be held liable for the crime.
