Tom handles all phases of business and complex commercial litigation including issues involving contract terms, credit terms, securities, intellectual property, health law, managed care, nursing homes, class action litigation, environmental matters, employment, insurance and product liability. Tom, a first chair trial lawyer and trained arbitrator with extensive experience in state and federal courts and in arbitration and administrative proceedings throughout the United States, represents high-profile clients of the firm. His most recent successes include: * arbitration award in favor of general contractor and over twenty subcontractors against owner/developer in high stakes dispute over construction of office and high end condominium project; * favorable resolution of two arbitrations of complex disputes arising from risk contracts between the firm's managed care clients and two integrated hospital networks; * favorable resolution of multi-million dollar contract disputes between a nationwide agricultural lender and multi-state agricultural products dealers; * favorable resolution of a multi-million dollar claim of breach of license, trademark and patent brought by an international agricultural company against a client of the firm that develops, manufactures and distributes genetically modified agricultural products; * an arbitrator's award in favor of a firm client on a dispute over the parties' contributions to remediate a well field in northern Michigan; * a favorable jury trial award against an international reinsurer relating to reinsurance of vehicle extended warranty contracts; * and a resolution of a $20 million claim of breach of warranty by a south Florida city that purchased diesel generators to support the city's power needs. He is also experienced in international discovery procedures having conducted discovery in the United Kingdom, numerous European communities, Canada and Puerto Rico. Tom manages all client activities, including assuming a first-chair role on significant cases and monitoring of assignments of all matters. He develops proformas and budgets for individual matters, reporting quarterly and annually on performance against budget and litigation strategy and routinely communicating with the general counsel. In this role, he has developed relationships with various companies' general counsel, assistant general counsel, outside counsel, presidents, chief financial officers and other key leadership of operating subsidiaries. In 1994, Tom helped to form a St. Louis Chapter of the American Academy of Attorney-Mediators and is an active member of that organization. He is on the list of mediators in the United States District Court for the Eastern District of Missouri, St. Louis Circuit Court for the City of St. Louis, St. Louis Circuit Court for the County of St. Louis, St. Charles County Circuit Court and Pinnacle Arbitration and Mediation Services.
