A.     THE FIRM

 

The firm of Farrah Munoko & Company Advocates (FM Advocates) is a registered firm that joined the highly competitive legal market on 21st April, 2015 and is engaged as a partnership in the practice of Law and Consultancy. Its offices at within Nairobi City County and are equipped with modern office and communication facilities comparable to a similar firm anywhere in the world. It has both professional and dedicated support staff some of whose details are provided hereunder.

 

The firm majors in Corporate & Commercial Law, Conveyancing, Litigation (both civil and criminal law), Employment & Labour Relations, Construction Law, Electoral Laws & Administrative disputes, Constitutional & Human Rights Law, Estate Management & Family Law among others. Corporate & Commercial Law

 

Through out the principal partners’ prior various experience gained from previous posts, they together bring to the firm vast proficiency in this area. The Principal Partners have both engaged in various tasks including providing legal advise to banks, related financial institutions and other corporate entities. Mr. Munoko has over the years acted as the chief legal advisor to Intex Construction Company, TM Construction Limited and Medanta AfriCare Limited. Mr. Farrah has also acted for a string of corporate entities in litigation arising there from and has registered tremendous success with almost all instructions issued. Employment Law and Labour Relations

 

The firm offers legal representation in court cases arising from employment disputes such as those that emerge upon employee termination and also in matters arising from trade disputes between an employer and its employee union. Advice is also offered on a variety of employment related issues such as:-

Ø  The drafting of employment contracts for various classes of workers.

Ø  Collective Bargaining Agreements.

Ø  Drafting of Legal documents required by statute such as Pension Scheme Deeds and various agreements to be entered into the Pension Scheme Service Providers. For continuing schemes, we offer advice on adherence to the requirements of the RBA.

 

Debt Recovery Services

 

In offering debt recovery services, we recognize that speed is of the essence especially when dealing with unscrupulous debtors who seek to adopt a variety of schemes to defeat creditors such as effecting changes to the names in which assets were originally registered. For optimal efficiency when dealing with such matters we have come up with the following mode of operation:-

 

-     We prepare and serve letter(s) demanding payment of the debt immediately upon receipt of instructions.

-     Where a decision to file a court case has been reached, we file the suit within three days upon lapse of the notice in the letter demanding payment.

-     Once a matter is in court, we pursue it diligently to ensure that the hearing dates are obtained promptly. We ensure active follow-up of court registry matters relating to fixing of hearing dates so as to avoid delays brought on by bureaucracy.

-     Upon obtaining judgment, we apply for warrants of execution immediately. In executing decrees, we only entrust auctioneers who have been carefully vetted for honesty, diligence and a proven track record in work performance.

-     We also mediate on amicable settlement of disputes where applicable and necessary.

 

 

 

 

 

 

Constitutional & Human Rights Litigation

 

The firm also offers legal advise and representation in this area of Law which the principal partners have through out their years of practice brought together a combined force to achieve results. Mr. Farrah who was serving as a Senior legal officer at WRAP, a non governmental human rights organization in Nairobi where he gained a lot of experience in the field of human rights especially child rights involving enforcing parental responsibility, custody and both international and local adoption proceedings.

 

Building & Civil Engineering Contract Law

The Firm also deals with Construction Law with Mr. Farrah having trained on FIDIC Principals, relevant local construction legislations and also acted for various Construction Companies in a variety of matters emanating within this field.

 

 

 

B.        THE PROFESSIONAL STAFF

 

1.      PARTNERS

 

The firm has two principal Partners with wide professional and corporate experience both locally and internationally. The profile of each of the two partners is as follows:

 

 

i.                    FARRAH HAMOUD DAWOOD.

 

Mr. Farrah is the founding partner of the firm having opted to join private legal practice after serving over a year in civil society. Hailing from the Republic of Uganda, Mr. Farrah chose to cross borders to engage in the practice of Law.

 

Mr. Farrah studied Law at Makerere University Kampala where he graduated with a Bachelors of Laws (LLB) Hons. and holds a Diploma of Law from Kenya School of Law. He was admitted as an Advocate of the High Court of Kenya in 2014 and has since actively engaged in the practice of Law in various positions.

 

 

Mr. Farrah undertook his articles of pupilage at the firm of M/s Ameyo Guto Etole & Company Advocates whereupon completion, he was retained as an Associate in the litigation and corporate department of the firm. Due to his passion for human rights, Mr. Farrah then joined WRAP, a registered NGO where he served as a Senior Legal Officer until he joined private legal practice.

 

Mr. Farrah also practices Law in Uganda where he initially trained as an Advocate and has as a result thereof garnered vast regional experience especially in litigation and Human Rights. 

 

 

ii.                 MOSES MUNOKO SITATI

 

Mr. Munoko is the co-founder and currently serving as the firm’s managing partner. He was admitted as an advocate of the High Court of Kenya in 2011 and also a Commissioner for Oaths. Upon admission, he worked as a legal assistant at the firm of M/s Nyandieka & Associates Advocates where he also undertook his articles of pupilage. Mr. Munoko later joined the firm of M/s Ameyo Guto Etole & Company Advocates in the year 2012 where he served as an Associate and was charged with heading the Civil Litigation Department.

 

Mr. Munoko studied Law at Moi University Kenya where he graduated with a Bachelor of Laws (LLB) Hons. and holds a Diploma in Law from Kenya School of Law. He brings into the firm vast experience in the field of Electoral Laws and Employment and labour Relations having previously acted for the Independent Electoral and Boundaries Commission (IEBC) and United Democratic Front (UDF) Party as litigation counsel and has registered notable successes at the Employment and Labour Relations Court respectively. He also has vast experience in Environment and Land Cases

 

Mr. Munoko has also handled various Corporate Clients including Intex Construction Company Limited, Medanta AfriCare Limited, Baseline Construction Ltd, TM-AM Construction Group among others whom have recommended him highly as such.

 

The firm has also retained Mrs. Anne Were Maloba Keya who is an Advocate of over 24 years standing as a consultant on Commercial and Corporate matters. Mrs. Keya is a holder of a Bachelors of Laws (LLB) Hons. From the University of Nairobi and a Diploma in law from Kenya School of Law. She is also an appointed Commissioner for Oaths and a Notary Public. Mrs. Keya handles consultancy for the firm primarily in the areas of Commercial Transactions, mergers and acquisitions.

 

2.      OTHER PROFFESSIONAL STAFF

The Firm also has various professional staff with whom the vision and mission of the firm is shared contribute invaluably to the success of the firm which in turn brings fast reliable results to our Clients. The profiles of the support staff include;

 

i.                    LYDIA KENYANI MISE

Ms. Mise studied Law from Mt. Kenya University Nairobi where she graduated with a Bachelor of Laws Degree (LLB) Hons. and is currently waiting to join Kenya School of Law to undertake the Advocates Training Programme (ATP) in to sit for her bar exams.

Ms. Mise serves as the legal assistant and office administrator of the firm who aids the principal partners in areas of Law and also the supervision of other support staff to implement the vision and mission of the firm. She previously worked at various Law firms including M/s Khaminwa & Khamniwa Advocates as a Legal Intern, M/s SM Chege & Company Advocates as a paralegal and at M/s Ameyo Guto Etole & Company Advocates as a legal clerk and office administrator.

 

Ms. Mise has vast experience in the field of Conveyancing, Court registry matters and Companies registration having garnered the same through out her previous posts which adds to the quick attainment of results for the firm’s clients.
