Experienced, committed, and respected in the practice of eminent domain law and property tax appeals, Richard De Angelis represents property owners and municipal governments in the State of New Jersey in matters of valuation litigation when property is targeted for a tax increase or for acquisition by government entities with the authority to condemn.
Since being admitted to the New Jersey Bar in 1998, Mr. De Angelis has been helping his clients to maximize their just compensation in tax recovery or condemnation awards involving office, industrial, retail or residential properties. His practical approach helps clients quickly identify an attainable goal and develop a strategy to achieve it within each individual’s circumstances.
“There is great satisfaction in achieving fair results for property owners in their dealings with government entities. It is professionally rewarding to address important constitutional questions concerning property taxation and just compensation for the taking of private property. “
He served for several years as Special Counsel for real property tax appeals for the Township of Randolph in Morris County and the Borough of Roseland in Essex County.
Representative Cases:
In 2008, Mr. De Angelis successfully appealed the dismissal of a client’s challenge to a blight designation, which had subjected the property to acquisition by condemnation, filed nine years after the statutory deadline. Under the precedent-setting decision in Harrison Redevelopment Authority v. DeRose, a property owner is now entitled to full and complete notice at the time of the blight designation and before the property may be acquired through eminent domain.
Professional Involvement:
1. New Jersey State Bar Association
2. Morris County Bar Association; Land Use Section
3. Lecturer and panelist for New Jersey Institute for Continuing Legal Education and New Jersey Redevelopment Authority
Noteworthy:
1. Associate municipal attorney in Phillipsburg (Warren County), Lyndhurst (Bergen County) and Jefferson (Morris County) handing land use, condemnation, licensing, and real property tax appeals.
2. Special Counsel to Acting Governor Donald DiFrancesco of New Jersey in 2001, advising on legal issues related to government ethics, employee conduct and communications. Also participated in vetting prospective cabinet nominees.
Reported Decisions:
1. Harrison Redevelopment Authority v. DeRose, 398 N.J. Super. 361 (App. Div. 2008)
2. Trebour Trs. v. Randolph Tp., 25 N.J. Tax 227 (Tax 2009)
