Important Appellate Victories:

  •     Jimenez v. TM Cobb: The California Supreme Court reversed earlier California appellate decisions and allowed Californians to bring strict liability lawsuits against window manufacturers.
  •     Leeds and Strauss v. Alpha Beta Markets: The Court of Appeal Mr. Eppsteiner was counsel; include Leeds and Strauss v. Alpha Beta Markets, which upheld an implied covenant of continuous operation in an anchor tenant’s lease.

Client Work

Stuart has represented clients in construction defects, products liability, class actions and insurance coverage litigation.

He has been appointed as class counsel several times in significant class actions, and has achieved six class action settlements, with estimated values between $80 and $235 million dollars.
