Neil M. Kerstein is located in the Quincy office of The Law Office of Neil M. Kerstein. He received his undergraduate degree from the University of Massachusetts at Amherst (B.A. 1973) and his legal education from Franklin Pierce Law Center (J.D. 1976). Mr. Kerstein was admitted to the Massachusetts and Federal Bars in 1977. Mr. Kerstein has over thirty (30) years of experience in general business, real estate, divorce, wills, trusts, estates, municipal, criminal and personal injury law and in higher education law consisting of the representation of higher education institutions (colleges, universities and proprietary schools) in a variety of litigation and transactional matters relating to Title IV financial aid, accreditation and general higher education law issues.

 

Mr. Kerstein's law practice includes the representation of individuals and all forms of entities in the areas of business law, divorce and family law, wills and estates, real estate, municipal law and zoning, criminal law, personal injury, education law and general litigation. Mr. Kerstein?s probate practice includes the representation of fiduciaries and interested parties in a wide range of probate proceedings, including the administration of estates, trusts, conservatorships and guardianships.

 

Mr. Kerstein has represented and provided advice to business clients in matters related to corporate/business strategy and on their general corporate/business and commercial legal affairs, including counseling and negotiating of general business transactions, mergers and acquisitions, joint ventures and the creation of special purpose entities (e.g. joint venture agreements, corporations, limited liability companies and trusts), as well as preparing legal documents for all types of business transactions, from simple contracts to complex shareholder and partnership agreements. Mr. Kerstein has represented and provided legal advice and counseling to sole proprietorships, small corporations and other business clients with in excess of 500 or more employees. Mr. Kerstein has provided legal representation to criminal defendants in all trial courts in the Commonwealth of Massachusetts.

 

In addition to his general business and litigation practice, Mr. Kerstein provides a full range of services to individuals, small businesses and corporations including buying, selling and/or developing real estate, divorce, estate or trust matters. Mr. Kerstein provides a full range of services in the areas of criminal law, general corporation law, litigation, real estate, personal injury, family law, divorce and probate matters including tort litigation, divorce (modification and contempt complaints), negotiation and drafting of simple and complex business agreements and separation agreements, or, in the event that the matter could not be settled, litigation related activities such as depositions, discovery requests, pretrial motions, asset valuations and trial and appeals.

 

Mr. Kerstein has represented all segments of higher education institutions including private and public schools, college and post graduate institutions in regard to accreditation applications, renewals and appeals, federal (Title IV) and state financial aid administration compliance reviews and appeals, Office of Inspector General audits and investigations as well as other legal issues pertaining to the field of higher education including all matters relating to Title 20 of the United States Code.

 

Mr. Kerstein successfully represented a Massachusetts community college successfully defending against a U.S. Department of Education, Office of Inspector General Student Financial Assistance (Title IV) audit in the amount of $2.2 Million Dollars with potential liability of $6.6 Million Dollars.

 

As a result of litigation filed on behalf of his client against the Commonwealth of Massachusetts, Mr. Kerstein was successful in obtaining an order by a Justice of the Superior Court, affirmed on appeal by the Supreme Judicial Court, to create the only medium secure mental health facility in Massachusetts at a cost of over $2.5 Million Dollars.

 

Mr. Kerstein has successfully represented his client in divorce proceedings in the Probate and Family Court of Massachusetts resulting in a property award to the wife of approximately $1.1 Million Dollars and alimony for life.

 

Mr. Kerstein is a former Special Assistant Norfolk County District Attorney appointed to represent the City of Quincy Building Department in enforcement matters before Justices of the Superior Court.

 

Mr. Kerstein is certified by the Probate and Family Court Administrative Office as a Guardian ad Litem/investigator eligible to receive appointments under Supreme Judicial Court Rule 1:07 for Category C-Counsel for child or parent; Category D-Probate of Wills, Accounts, settlements; Category F-custody, visitation, adoption and Category J-Commissioner for partition of real estate.

 

Mr. Kerstein has accepted numerous appointments as a Guardian ad Litem (GAL) and Commissioner in the Probate and Land Courts sitting in Norfolk, Suffolk, Middlesex and Plymouth counties in Massachusetts involving a wide range of family law matters and the court ordered sale of real estate.

 

Mr. Kerstein?s experience as a GAL includes issues involving custody and visitation, removing children from the Commonwealth, changes in circumstances warranting modification of court orders, existence of a de facto parent-child relationship, parental fitness, paternity and other rights and interests of family members.

 

Mr. Kerstein is a former instructor at Quincy College where he founded the Quincy Paralegal Program. He is also a former President of the Board of Directors of Cerebral Palsy of the South Shore. Mr. Kerstein was a member of the South Shore Chamber of Commerce Real Estate Committee.

 

Mr. Kerstein was president and co-founder of ARVIS Information Systems, Inc. ? providing CD ROM subscriptions and internet access to Department of Education Title IV Student Financial Assistance Administrative Decisions to institutions of higher education including colleges, universities and proprietary schools.
