David Mizrachi

Mr. Mizrachi has served as local co-counsel in multi-million dollar commercial arbitrations under the auspices of the American Arbitration Association; in litigation against fashion apparel licensors in Federal Court in New York and in a successful request for US based discovery in front of a Federal Court in Atlanta in aid of an action pending in a Panamanian Court. As part of his recent transactional practice, Mr. Mizrachi has negotiated many distributorship and licensing agreements with international manufacturers and licensors; represented an international design company which was awarded a multi-million dollar public bid to renovate Panama’s international airport and drafted and negotiated several e-commerce contracts on behalf of local banks. Mr. Mizrachi also served as defense co-counsel in multi-million dollar tort claim against one of Panama’s largest banks; successfully defended a large retail chain against charges brought by European apparel company of selling allegedly counterfeit goods which were proven to be authentic; served as Panamanian counsel in large venture capital deal involving regional IT distributor and assisted a Panamanian bank in successful pre-qualification to bid for management of a government pension fund in conjunction with a Florida based investment management firm. He recently represented a UK based oil and gas enterprise in the negotiations and execution of a contract with the Panamanian Government for offshore exploration and production. Mr. Mizrachi has assisted foreign counsel in recovering assets in Panama and recently acted as Panamanian counsel in a tortuous interference action filed in Federal District Court in New York which resulted in a convenient settlement for his Panama based licensee client. Mr. Mizrachi also represents an important American stakeholder in a large contested estate proceeding in Panama and a Major League Baseball team in a litigation matter in Panama. He also has conducted due diligence in several acquisitions by American and European companies doing business in Panama and in many real estate deals. Additionally, Mr. Mizrachi has served as an expert on Panamanian law in several court cases including New York State Court and Federal District Courts in Florida and Indiana. He spoke at the Florida Bar International Litigation and Arbitration Conference in Miami in 2006 and 2007 and at the Lexis Nexis (Butterworths) Fraud and International Litigation Conference in London in November of 2006. His firm is the Panamanian affiliate firm of ICC FraudNet and Trace International. Mr. Mizrachi was recommended by “Which Lawyer?” (Practical Law PLC, 2007), in the areas of Corporate and M&A, is the author of the Panama Section of the Digest of Commercial Laws of the World (Oceana Publications, 2006) and has addressed United States Trade Delegations from Illinois, Florida, Mississippi and Wisconsin about the legal aspects of doing business in Panama. In July of 2007 he was part of a delegation of Panamanian Jewish leaders hosted by the American Jewish Committee which met with US Congressional leaders in Washington DC in support of the ratification of the US-Panama Trade Promotion Agreement. Fluent in Spanish and English with basic knowledge of Hebrew.
