The Time Limit to Sue an Attorney in California for Malicious Prosecution is set in CCP 340.6
In this case of first impression, the California court had to decide what statute of limitation applies to a malicious prosecution action against an attorney. Held: Section 340.6 of the California Code of Civil Procedure applies, which states the action must be commenced 'within one year after plaintiff discover, or through the use of diligence should have discovered, ... or four years from from the date of the wrongful act or omission, whichever occurs first.'
