Stipulated Transfer of Venue Renews 60-Day Time Limit to Bring Anti-SLAPP Motion in California
Strategic Lawsuit Against Public Participation ('SLAPP') is litigation aimed at chilling exercise of protected free speech. Section 425.16 of the California Code of Civil Procedure allows a defendant to bring an anti-SLAPP motion within 60 days after service of a SLAPP complaint. This case held that parties' stipulation to transfer venue renewed the 60-day time limit to bring anti-SLAPP motion. [Advance sheet courtesy of www.metnews.com]
