Employer Policy Disqualifying Applicant Due to Positive Drug Does Test Does Not Violate ADA
In this recent decision of Lopez vs. Pacific Maritime Association, the Ninth Circuit Court of Appeals reviewing a decision by the U.S. District Court in California held: an employer's policy permanently permanently disqualifying job applicants who test positive for drug use does not violate the Americans with Disabilities Act ('ADA').
