Plaintiff May Sue Trainer Despite Signing Release of Liabilties if Trainer was Grossly Negligent
Eriksson vs. Nunnink - This is the story of a 17-year-old horse rider and her trainer. The competition horse was recently injured, but trainer who had duty to take care of the horse, convinced rider's mother that the horse was fit for competition based on which the mother allowed her daughter to ride the horse. During the competition, the horse tripped on a hurdle and crushed the rider to death. Horse trainer may be liable, despite a signed release form, if the trainer was grossly negligent.
