Attorney's Gross Negligence is Grounds for Relief from Dismissal of the Action
In the case of Lal vs. State of California, 06-CV-05158-PJH, the Ninth Circuit Court of Appeals held that gross negligence by plaintiff's attorney leading to dismissal of the case is considered an 'extraordinary circumstance' under Section 60(b)(6) of the Federal Rules of Civil Procedure and would be grounds for relief from case dismissal.
