Boeken v. Phillip Morris USA, Inc.
Plaintiff's husband was disagnosed with lung cancer, and Plaintiff sued cigarette manufacturer for loss of companionship and affection. That action was dismissed with prejudice. After her husband passed away from lung cancer, Plaintiff again sued the cigarette manufacturer for wrongful death seeking compensation for loss of companionship and affection. The California Supreme Court held: the doctrine of res judicata prohibits a second suit between the same parties on the same cause of action.
