Anti-SLAPP did not Apply to a Lawsuit Claiming a Private 'Organic' Standard was Misleading
Federal stautes define what is considered 'organic' for food substances, but not for personal care products. Organic and Sustainable Industry Standards (OASIS) came up with an 'OASIS Organic' standard to be applied to beauty and personal products, and plaintiff sued claiming this standard constitute unfair competition and misleading advertising. OASIS sued under Anti-SLAPP. The court held, Plaintiff's lawsuit was not a a strategic lawsuit against public participation (SLAPP).
