California Court holds Indian Child Welfare Act (ICWA) does Not apply to Delinquency Proceedings
This case involved a minor of Native American decent who had been convicted of residential burglary and was ordered by court to be placed in a suitable foster home, group home, relative home, county or private facility, and directed the minor to comply with terms of probation. Defendant appealed saying he was not afforded notices under Indian Child Welfare Act (ICWA).
