California Supreme Court Decision on Good Samaritan Laws

In the 2008 decision of Van Horn v. Watson, the California Supreme Court re-visited the Good Samaritan legal principle that a person does not have a duty to come to aid of another, but one who does come to aid of another must exercise due care. The Court held that Section 1799.102 of the California Health and Safety Code, which provides an exception to the general Good Samaritan law, applies only for persons who render emergency 'medical care.'
