Motion to Strike Complaint as SLAPP

Strategic Lawsuits Against Public Participation ('SLAPP') are civil complaints which chill valid exercise of free speech. California's anti-SLAPP statutes are found in Sections 425.16 and 425.17 of the California Code of Civil Procedure. These sections allows the party whose valid exercise of free speech is being chilled to bring a special motion to strike the offending civil complaint. The statutes also allow recovery of attorney's fees and costs by the party prevailing on the anti-SLAPP motion.
