In California Successful Party to Administrative Hearing May Recover Attorney's Fees
Church obtained a conditional use permit from County to build an 11,000 square foot facility, and the neighboring land owner brought petition for writ of mandate to direct County to rescind the permit. After County board adopted resolution to rescind the permit, Petitioners dismissed their petition and sought $35K in attorney's fees pursuant to Section 1021.5 of the California Code of Civil Procedure. Held: A party may recover attroney's fees in an administrative proceeding pursuant to Section 1021.5.
