Mediation Brief in Dog Bite Case
Plaintiff was kissing her uncle's dog when the dog bit off a portion of her upper lip. Normally, plaintiffs try and prove the dog was both vicious and well-known for being vicious. In this case, we turned it around and proved that 'Spunky' was a family friendly dog and that Plaintiff was not negligent for kissing him. This case settled for over 6 figures. We also had to deal with a 'vicious dog' exclusion in the homeowner's policy.
